Terms of Service
1. Who these terms are between
These terms are an agreement between you and [LEGAL ENTITY NAME], registered at [REGISTERED ADDRESS], India (CIN [CIN] · GSTIN [GSTIN]), which operates RentalSpaces.in. By using the site you accept them. If you do not accept them, do not use the site.
This is an electronic record under the Information Technology Act, 2000 and does not require a physical signature.
2. What RentalSpaces is
RentalSpaces does two things. We host listings that owners and agents create — for that part of what we do we are an intermediary under section 2(1)(w) of the Information Technology Act, 2000. We also act as a broker: our own team and our area franchise partners introduce seekers to properties, help agree terms, and see a tenancy through to signing. We charge brokerage for that work. Section 3 explains how.
Which of the two applies depends on the deal. Many enquiries never go further than us hosting a listing and passing on contact details; brokerage does not arise on those. Where we or a franchise partner take an active part, we will tell you, and we will tell you the fee before you commit to anything.
Even on a deal we broker, we do not:
- own, value or manage any listed property, unless we have separately agreed in writing to manage it;
- guarantee that a listing is accurate, current, or still available;
- guarantee that any tenancy will be granted, renewed, or performed by either side;
- hold your deposit or rent — you pay those to the owner directly, unless the written terms of your deal say otherwise.
Where neither we nor a franchise partner is handling the deal, the tenancy is solely between you and the other party. Either way, verify ownership documents, identity and the condition of the property yourself before paying any deposit or rent.
3. Brokerage, and how franchise partners work
We charge brokerage. RentalSpaces runs a real-estate brokerage alongside the listings platform, and earns brokerage on tenancies it helps bring about.
Franchise partners. We appoint a franchise partner for an area. That partner is an authorised representative of RentalSpaces for rentals in that area — they handle viewings, negotiation and paperwork there, and they earn the brokerage on the deals they handle. A franchise partner is an independent business operating under our brand and our rules, not our employee. They may act only within the authority we give them: they cannot change these terms, cannot take money on our behalf other than through the payment methods we publish, and cannot make promises about a property that the owner has not made. If a franchise partner tells you something that conflicts with these terms, these terms apply — and please tell us at hello@rentalspaces.in.
How much, and who pays. Brokerage is deal-dependent. The amount, and whether the owner pays it, the tenant pays it, or both pay a share, is agreed for each transaction and depends on the property, the rent, the city and the work involved. There is no single blanket rate and no fixed payer.
The one fixed rule. If you are an owner, you list your property directly on RentalSpaces, and that property is let through us, you pay RentalSpaces brokerage equal to one month's rent, plus GST. "One month's rent" means the monthly rent stated in the tenancy that is signed. It becomes payable when the rent agreement is signed or the tenant takes possession, whichever happens first, and is due within [BROKERAGE PAYMENT DAYS] days of our invoice.
You will always know the fee before you commit. Before a tenancy is signed and before any money changes hands, we will tell you in writing — WhatsApp, email or a signed agreement — what the brokerage is and who is paying it. If nobody has given you a figure, do not sign; ask us first.
Brokerage is separate from, and on top of, anything you buy on this site. Contact unlocks, Managed Rental Assistance and subscription plans do not include brokerage and do not reduce it, unless we have said so in writing for your particular deal.
4. Your account
You sign in with your mobile number and a one-time password. Keep access to that number secure — anything done through your account is treated as done by you. You must be at least 18 and legally able to enter a contract. Give us accurate details and keep them current.
5. Listing a property
By publishing a listing you confirm that:
- you own the property, or are authorised in writing by the owner to let it;
- the rent, deposit, area, address and amenities you state are accurate;
- the photographs are of that property, taken by you or used with permission;
- the property is genuinely available to let.
If you list as an owner, you also accept the brokerage in section 3 — one month's rent, payable to us, if the property is let through RentalSpaces.
You keep ownership of what you upload. You grant us a non-exclusive, royalty-free licence to display, resize and distribute it for the purpose of running and promoting the platform, for as long as your listing is published and for 12 months after.
We may edit, unpublish or remove any listing that appears inaccurate, duplicated, unlawful, discriminatory, or that has already been let — and we may suspend accounts that repeatedly post such listings.
6. What you must not do
- Post a property you have no right to let, or a listing that does not exist.
- Refuse or restrict a tenancy on the basis of religion, caste, race, sex, place of birth, food preference or marital status.
- Scrape, copy or republish listings or contact details in bulk.
- Contact users for anything other than the tenancy — no marketing, no spam.
- Attempt to bypass paid contact unlock, or resell unlocked contact details.
- Take a deal off the platform to avoid brokerage on an introduction we or a franchise partner made for you.
- Upload anything unlawful, misleading, defamatory or infringing.
7. Validity, and no refunds
All payments to RentalSpaces are final and non-refundable. This applies to contact unlocks, Managed Rental Assistance, and every subscription plan — whether or not you go on to rent a property, and whether or not you use what you bought.
Everything you buy is valid for 12 months from the date of purchase. At the end of that period it lapses. Anything unused — remaining contact unlocks, listing slots, or any other entitlement — expires and does not carry forward into a new purchase or a renewed plan, and is not exchanged for credit or cash.
Brokerage works differently: it is not bought in advance and it is not an entitlement with an expiry. It is charged on a tenancy that actually completes, on the terms agreed for that deal under section 3.
Please decide before you pay. If you are unsure whether a service fits your situation, ask us first at billing@rentalspaces.in — we would rather answer a question than take a payment you did not want.
This clause does not affect any right you have under the Consumer Protection Act, 2019 where a service has not been delivered at all, or where a payment was taken in error or duplicated. Write to billing@rentalspaces.in and we will investigate.
8. What each paid service gives you
Contact unlock. A one-time fee reveals the lister's name and phone number, and gives them yours so they can respond. That exchange is the entire service, and it is complete the moment the details are shown. We do not promise the lister will answer, that the property is still available, or that a tenancy will follow.
Managed Rental Assistance (₹3,999 + GST). Our team compiles a shortlist of 5–10 verified, available rental properties matching the city, budget and requirements you give us, normally delivered within 24–48 hours by WhatsApp and email. If the shortlist misses the brief you gave us, tell us and we will refine it once at no charge.
The ₹3,999 buys the research and the shortlist, and nothing beyond it. It is not brokerage and does not pre-pay brokerage. If you go on to take one of the properties on that list and we or a franchise partner broker that deal, brokerage under section 3 applies on top — and we will tell you the figure before you commit. We do not guarantee that you will take any property on the list.
Subscription plans. Plan features and limits are those shown on the pricing page at the time you subscribe. A plan runs for its stated term from the purchase date and does not auto-renew unless the checkout said so.
9. Payments
Payments made on the site are processed by Razorpay. We do not see or store your card, UPI or netbanking details. Brokerage is invoiced separately by us or by the franchise partner handling your deal, and is payable by the method stated on that invoice — never in cash to an individual without a receipt in the RentalSpaces name. Prices are in Indian Rupees and exclusive of GST unless stated otherwise. A tax invoice is issued for every payment, brokerage included. Billing questions: billing@rentalspaces.in.
10. Reporting unlawful content
If a listing is fraudulent, infringes your rights, or is otherwise unlawful, write to our Grievance Officer, [GRIEVANCE OFFICER NAME], at hello@rentalspaces.in with the listing URL and the reason. We acknowledge within 48 hours and act within the timelines set by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
Complaints about the conduct of a franchise partner go to the same address. We investigate them ourselves and will tell you the outcome.
11. Our liability
The site is provided "as is". To the extent Indian law allows, we are not liable for any loss arising from a listing's accuracy or availability, from the conduct of any owner, agent or tenant, from a tenancy or its breakdown, or from any deposit or rent you pay to another party.
That exclusion covers our role as a listings platform. Where we or a franchise partner act as broker on your deal, we are responsible for doing that work honestly and with reasonable care, and we do not exclude liability for what we or that partner do in that role. It stays your responsibility to satisfy yourself about the property and the other party before you sign anything or pay anyone.
Where liability cannot be excluded, our total liability to you is limited to the amount you have actually paid us in the 12 months before the claim, including any brokerage you paid us.
Nothing here limits liability for fraud or for anything that cannot lawfully be limited.
12. Suspension
We may suspend or close an account that breaches these terms, or that we reasonably believe is being used fraudulently. Where we can, we will tell you why and give you a chance to respond. Fees already paid for services already delivered are not refunded on suspension for breach, and brokerage already earned on a completed tenancy remains payable.
13. Changes
We may update these terms. The date at the top shows when they last changed. If a change materially affects your rights, we will give notice by email or on-site before it takes effect. Continuing to use the site after that means you accept the change.
14. Governing law
These terms are governed by the laws of India. The courts at [CITY OF JURISDICTION] have exclusive jurisdiction over any dispute.
